Maintenance is one of the most contested issues in a divorce. Previously referred to as alimony, maintenance is spousal support paid from one spouse to another. Maintenance can be ordered on a temporary basis, while the divorce is pending, or as part of a final divorce judgment.
Factors Considered for Maintenance
Many factors are considered to determine whether maintenance is appropriate, such as:
Income and property of each party
Needs of each party
Earning potential of each party
Effect of the custody or parental responsibility arrangements
Standard of living during the marriage
Impact of a party devoting time to domestic duties (such as delaying education, training, or employment due to the marriage)

Amount and Duration of Maintenace
If it is determined that a party is a maintenance candidate, the court must follow a formula to determine both the amount and the duration. The amount is based on the net income of each party, and the duration is based on the length of the marriage. Although the court has the discretion to deviate from these formulas, there must be a reason to deviate upward or downward. For example, the court could find that a party could be earning a higher income and impute a higher income to them when calculating the amount of maintenance.
Many issues can arise when contesting maintenance. Parties often dispute the reasons that one party is unemployed or underemployed, past agreements during the marriage, and the resources and needs of each party. Whether maintenance is being litigated in court or negotiated in settlement discussions, the family law attorneys at Abramovitch Blalock & McKinnon will present all facts that support your case and help you achieve the best possible outcome.
