Amount and Duration of Maintenace

If it is determined that a party is a maintenance candidate, the court must follow a formula to determine both the amount and the duration. The amount is based on the net income of each party, and the duration is based on the length of the marriage. Although the court has the discretion to deviate from these formulas, there must be a reason to deviate upward or downward. For example, the court could find that a party could be earning a higher income and impute a higher income to them when calculating the amount of maintenance.
