Experienced & Trusted Divorce Advocates in Illinois
Divorce can be one of the most difficult experiences. The dissolution of the relationship itself is often emotionally painful and grievous, and the expenses, lengthy procedure, and difficult decisions to make further complicate the process. At Abramovitch Blalock McKinnon, our Illinois divorce lawyers are thoroughly familiar with Illinois divorce laws and procedures and are prepared to provide compassionate and clear legal advice and, if needs be, aggressively advocate on your behalf in court.
Illinois is a “no-fault” divorce state, which means the only basis for a divorce is irreconcilable differences. Neither party is blamed for the end of the marriage. The only requirements to file for divorce in Illinois are: 1) One party must have resided in Illinois for at least 90 days, and 2) the parties must have been living separate and apart for at least 6 months. “Separate and apart” means that the parties are no longer living as though they are in a relationship, and does not mean physically residing in two different places. You can file for divorce while still residing with your spouse.
Handling All Aspects of Divorce in Chicago
Once the above requirements are met, there are a number of issues to address and factors that must be considered before a judge will finalize the divorce. A variety of issues can be involved in a divorce, including:
Dividing marital property
Protecting non-marital property
Establishing maintenance (previously referred to as alimony)
Creating a parenting time schedule
Assigning decision-making responsibility for children
Determining child support
Allocating college expenses
